1. ACCEPTANCE OF TERMS

By accessing the website www.marchealpin.ca or making a purchase (online or at our warehouse sales), you agree to be bound by these terms of use. If you do not agree to these terms, please do not use our site or participate in our sales events.

Marché Alpin reserves the right to modify these terms at any time without prior notice. It is your responsibility to review them regularly. Continued use of the site after any modification constitutes your acceptance of the new terms.

2. NATURE OF PRODUCTS

2.1 New Products — Surplus and Samples

All products sold by Marché Alpin are new and unused. Our inventory consists exclusively of:

• Inventory surplus: excess products from manufacturers or distributors in the outdoor sector.
• Collection samples: demonstration or pre-launch items, never sold through regular retail channels.

Marché Alpin does not sell any used, reconditioned, or refurbished products.

2.2 "Sample — Not for Resale" Mark

Some sample products may bear the mark "Sample — Not for Resale" on their label. This inscription is applied by the manufacturer because these items are distributed up to one year before their official market launch date and cannot be legally resold through usual distribution channels during this period. Once this period has passed, Marché Alpin is authorized to market them. This mark does not affect the quality of the product or the buyer's rights in any way.

2.3 Product Variations and Condition

Due to the nature of our inventory (surplus and samples), the following are possible and do not constitute a defect:

• Slight aesthetic variations compared to the images shown on the website
• Minor wear and tear on packaging (creased box, damaged bag, etc.)
• Minor cosmetic imperfections with no impact on product functionality
• Partial absence of original packaging or non-functional secondary accessories

For samples, available sizes, colors, and models are limited and may differ from the final commercial versions.

3. FINAL SALE POLICY

3.1 General Principle

All sales are final, whether for online purchases on www.marchealpin.ca or purchases made at our warehouse sales. No exchanges, refunds, or returns are accepted, except in cases provided for in section 3.2.

This policy applies to all our products, including inventory surplus and samples.

3.2 Exception: Defective Product

Marché Alpin accepts returns only if a product presents a proven manufacturing defect at the time of receipt. A defect includes:

• A malfunction of the product in its normal intended use
• A missing essential part for the product's use
• Structural damage not related to handling or use

The following do not constitute a defect:

• Aesthetic variations described in section 2.3
• Damage caused by misuse, improper storage, or normal wear and tear
• Color difference due to lighting or screen settings

For any return due to a defect, you must contact us at info@marchealpin.ca, providing proof of purchase and photos of the observed defect.

3.3 Compliance with the Consumer Protection Act (Quebec)

These terms are established in compliance with the applicable provisions of Quebec's Consumer Protection Act (CQLR, c. P-40.1). In case of conflict between these terms and the mandatory rights provided by this law, the legal provisions shall prevail.

4. PRODUCT AVAILABILITY AND ORDER MANAGEMENT

4.1 Limited Quantities

Our products are available in very limited quantities. Marché Alpin reserves the right to:

• Limit the quantity of identical products that can be purchased per order or per customer
• Partially or completely cancel an order if inventory is insufficient at the time of processing
• Remove a product from sale at any time without prior notice

4.2 Order Cancellation due to Out-of-Stock

If an ordered item is no longer available at the time your order is processed, you will be informed as soon as possible and fully refunded for that item. No substitutions will be made without your prior agreement.

4.3 Pricing or Display Errors

In case of a pricing error, display error, or technical issue on our website (including, but not limited to, an incorrect price, a $0 display, or a computer malfunction), Marché Alpin reserves the right to cancel the affected order. Such errors do not constitute valid contractual consent under applicable Quebec laws. The customer will be informed and fully refunded if payment has been made.

5. PRODUCT IMAGES AND DESCRIPTIONS

Product images and descriptions on our site are provided for informational purposes only. Due to the nature of our stock (surplus and samples):

• Actual colors may vary slightly depending on lighting or your screen's display settings
• Finishes or aesthetic details may differ from photos
• Indicated dimensions are approximate and may have slight variations

We make all reasonable efforts to accurately represent our products. However, these minor variations do not give rise to a return or refund.

6. ONLINE ORDERS AND PAYMENT

6.1 Ordering Process

An order placed on www.marchealpin.ca constitutes an offer to purchase from you. The sale is concluded only when you receive an order confirmation from us. We reserve the right to refuse or cancel any order for any reason whatsoever, including suspected fraud or exceeding authorized quantity limits.

6.2 Payment

Payment is required at the time of order. All transactions are conducted in Canadian Dollars (CAD) and are subject to applicable taxes (GST/QST).

6.3 Payment Security

Online transactions are secured by an SSL encryption protocol. Marché Alpin does not store complete credit card information on its servers.

7. DELIVERY AND SHIPPING

7.1 Delivery Times

Delivery times are estimates and may vary depending on the carrier, destination, and factors beyond our control (weather conditions, strikes, postal delays, etc.). Marché Alpin cannot be held responsible for delays caused by third-party carriers.

7.2 Transfer of Risk

The risk of loss or damage is transferred to the buyer upon delivery of the package to the carrier. In case of damage during transit, it is the buyer's responsibility to file a claim directly with the carrier.

7.3 Delivery Zones

We deliver to Quebec, Ontario, British Columbia, Alberta, Saskatchewan, Manitoba, New Brunswick, Nova Scotia, and Prince Edward Island. Any order to an unserved destination will be cancelled and refunded.

8. WAREHOUSE SALES

Physical warehouse sales are governed by the same general conditions as online sales, including:

• Final sales: no returns or exchanges except for manufacturing defects
• Limited quantities: products are sold on a first-come, first-served basis
• Marché Alpin reserves the right to adapt the rules of sales events (access hours, limits per person, etc.) without prior notice

9. LIABILITY AND LIMITATION OF WARRANTY

All products and services are provided "as is", without explicit or implicit warranty beyond what is provided by law.

9.2 Exclusions of Liability

Marché Alpin cannot be held responsible for:

Marché Alpin's total liability, regardless of cause, is limited to the amount actually paid for the product concerned.

9.4 Warning Regarding Outdoor Equipment

Certain outdoor equipment (safety equipment, technical gear, etc.) requires adequate training for proper use. Marché Alpin recommends that all buyers seek professional training before using any safety or high-risk activity equipment. We disclaim all responsibility for accidents related to non-compliant use or use without appropriate training.
